Terms of Service

1. Acceptance of Terms

By accessing or using Nexon OS, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Description of Service

Nexon OS provides a suite of cloud-based platforms for SMEs, education providers, and creative agencies, including business management, tutoring, design, and staff management tools. Each platform is accessed via a separate subscription.

3. Accounts and Registration

• You must provide accurate and complete information when registering
• Each platform requires a separate registration and subscription
• You are responsible for maintaining the security of your account and password
• You must be at least 18 years old to register, or have parental/guardian consent for the student platform
• One account per user per platform — multiple platforms require separate registrations

4. Subscriptions and Billing

• Each platform offers monthly, biannual, and annual subscription plans
• All plans include a 5-day free trial — no payment is required during the trial
• After the trial, you must select a plan and submit proof of payment via WhatsApp
• Subscriptions are activated once payment is verified by Nexon staff
• You may cancel your subscription at any time — access continues until the end of the paid period
• Refunds are handled on a case-by-case basis at management's discretion

5. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose
• Upload viruses, malware, or harmful code
• Attempt to access another user's data without authorisation
• Reverse engineer, decompile, or disassemble any part of the platform
• Spam, harass, or harm other users
• Share your account credentials with others

6. Intellectual Property

Nexon OS, including its software, design, content, and branding, is the intellectual property of Nexon Apps Global Pty Ltd. Content you create on the platform remains your property. You grant us a licence to host and process your content as needed to provide the service.

7. Data and Privacy

Your use of personal data is governed by our Privacy Policy, which complies with the Protection of Personal Information Act (POPIA). By using Nexon, you consent to the data practices described in our Privacy Policy.

8. Service Availability

We strive to maintain 99.5% uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for downtime caused by factors beyond our control.

9. Limitation of Liability

Nexon is not liable for indirect, incidental, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Termination

We may suspend or terminate your account if you breach these Terms. You may close your account at any time by contacting support. Upon termination, your data will be retained for 30 days before permanent deletion.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Cape Town, Western Cape.
